User Agreement

1. About CareersHeights

CareersHeights is an online marketplace that connects Users seeking career guidance with independent career coaches, mentors, and industry experts ("Experts").

CareersHeights:

• Does not provide coaching or professional advice
• Does not employ or supervise Experts
• Is not responsible for the quality, accuracy, or outcomes of Expert services
• Acts solely as a technology platform and intermediary

Experts are independent service providers and are solely responsible for the services they deliver.

2. Eligibility

To use the Platform, you must:

• Be at least 18 years old
• Provide accurate and truthful information
• Have the legal capacity to enter into this Agreement

You may not use the Platform if you have been suspended or banned.

3. User Account Responsibilities

You agree to:

• Maintain the confidentiality of your login credentials
• Use your account only for personal, non commercial purposes
• Provide accurate information and keep it updated
• Notify us immediately of unauthorized access

You are responsible for all activity under your account.

4. Booking Sessions

Users may book:

• 1:1 coaching sessions
• Group sessions
• Resume reviews and document services
• Other services offered by Experts

By booking a session, you enter into a direct contract with the Expert.

CareersHeights is not a party to that contract.

5. Payments

Payments are processed through third party providers such as Stripe.

You acknowledge that:

• CareersHeights does not store full credit card or banking information
• Payment processing may involve cross border data transfers
• You must comply with the payment processor's terms

Applicable GST/HST will be charged where required by law.

6. Uploaded Documents

Users may upload documents such as:

• Resumes
• Cover letters
• Portfolios
• Job descriptions

By uploading content, you confirm that:

• You own or have rights to the content
• The content does not violate any laws or third party rights
• You grant CareersHeights a limited license to store and transmit the content for Platform functionality

You may delete uploaded documents at any time.

7. User Conduct

You agree not to:

• Harass, abuse, or harm Experts or other Users
• Upload harmful, illegal, or infringing content
• Attempt to bypass the Platform's payment system
• Misrepresent your identity or intentions
• Engage in fraud or misuse of the Platform
• Interfere with Platform operations

CareersHeights may suspend or terminate accounts that violate these rules.

8. Refunds & Cancellations

Refunds and cancellations are governed by the Refund & Cancellation Policy, which forms part of this Agreement.

Key principles include:

• Users may cancel within the permitted window for a refund
• No shows are generally non refundable
• Expert cancellations result in full refunds
• Document review refunds depend on whether work has begun

9. Disputes with Experts

If you have a dispute with an Expert:

• You should attempt to resolve it directly
• CareersHeights may request information from both parties
• CareersHeights may issue refunds or take action at its discretion

CareersHeights is not obligated to mediate disputes but may do so to maintain platform integrity.

10. Intellectual Property

All Platform content (excluding User generated content) is owned by CareersHeights.

You may not:

• Copy, reproduce, or distribute Platform content
• Reverse engineer or modify the Platform
• Use the Platform for commercial purposes without permission

You retain ownership of your uploaded content.

11. Privacy & Data Protection

Your use of the Platform is governed by our Privacy Policy, which complies with PIPEDA and outlines:

• What personal information we collect
• How it is used
• How it is stored
• How long it is retained
• Your rights regarding your data

By using the Platform, you consent to the collection and processing of your personal information as described in the Privacy Policy.

12. Limitation of Liability

To the fullest extent permitted by law:

• CareersHeights is not liable for the actions, advice, or omissions of Experts
• CareersHeights is not responsible for outcomes of coaching sessions
• CareersHeights is not liable for indirect or consequential damages

CareersHeights' total liability is limited to the greater of:

• $100 CAD, or
• The total amount you paid to CareersHeights in the six months preceding the claim

Nothing in this Agreement limits liability where prohibited by law.

13. Termination

CareersHeights may suspend or terminate your account if:

• You violate this Agreement
• You engage in fraud or harmful conduct
• Required by law or security concerns

You may delete your account at any time.

Upon termination:

• Access to your account is revoked
• Certain data may be retained for legal or financial reasons

14. Changes to This Agreement

We may update this Agreement from time to time.

When changes occur, we will:

• Update the "Effective Date"
• Provide notice for material changes

Continued use of the Platform after changes take effect constitutes acceptance of the updated Agreement.

15. Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada.

Consumers retain the right to bring disputes before Ontario courts.
